It's interesting to note the number of issues that reappear on a more-or-less regular basis. Some cycle through every few years, while others seem to pop up almost monthly. Those of us in the business of disseminating information often greet those concerns with the admonition, "Golly, why didn't they read what we said about that one (week/month/year) ago!" Unfortunately, as writers we often forget three things:
- The information we provided was not read by the individual because the concern didn't exist for them at the time it was written.
- We tend to assume (mistakenly) that every gem we pen is important, mandatory reading.
- Every day backward in time creates a larger group who didn't even have the opportunity to read what we wrote. Over a period of one year, 20 to 25% of the membership is new.
The letter that occasioned the comments above dealt with operating radios on the ham band (six meters). Specifically, it related to allowing unlicensed individuals to operate six-meter radio-control equipment if a properly licensed amateur turns it on and off and stands nearby to monitor.
The apparent permission for this type of activity comes from Part 97 of the FCC regulations. However, please note the word apparent — such operation is not allowed by the FCC interpretation of those rules.
In 1980 the Academy approached the FCC to review their interpretation of these rules and requested that such activity be allowed. The FCC issued Report Number 2143 on November 7, 1980. The report states, in part:
"The Commission has affirmed a staff ruling barring unlicensed persons from using Amateur radio stations to control model aircraft, despite a request by the Academy of Model Aeronautics (AMA) that the ruling be reversed.
"The basis of the staff's ruling was its interpretation of Section 97.79(d) of the rules, which permits an unlicensed person (third party) to participate in two-way Amateur radio communications under the supervision of a control operator. Since the use of an Amateur radio station for controlling model aircraft constitutes one-way transmission, the rules did not permit its being operated by an unlicensed person.
"In seeking review, AMA questioned whether the Private Radio Bureau erred in its construction of the term 'third party,' whether it improperly interpreted Part 97 in holding that the radio control provisions were not parallel in all respects to the Radio Control Service rules, and whether its interpretation of third party was inconsistent with other Part 97 rules and long-recognized Amateur practice.
"Despite AMA's contention that Section 97.79(d) is broader than 97.3(v) and defines the scope of permissible participation by nonlicensees in Amateur communications, the Commission stated that these two sections, as well as Section 97.114 which specifies the conditions under which third-party traffic may be sent, are all interrelated and not intended to provide for the nonlicensed Amateur communications desired by AMA.
"Turning to AMA's argument that the Bureau ignored the parallelism between the Amateur Radio Service rules and Radio Control Service rules, the Commission pointed out that nowhere in its rulemaking proposal in Docket 19572 was it suggested that all the rules relating to operation of a radio station in the Radio Control Service for controlling a remote object would be carried over into the Amateur Radio Service when an Amateur station was so used.
"As for AMA's claim that Section 97.79(d) should have the term 'two-way' added to its provisions, and since it does not, a nonlicensed person should be able to engage in all types of communications permitted by Sections 97.89 and 97.91, the Commission disagreed, stating that Section 97.79(d) requires the presence of a control operator to continuously monitor message content of the radio transmission. It would be ludicrous for the FCC, the Commission added, to require monitoring of the steady hum or tone signal used in a typical one-way communication designed to control a remote object.
"The Commission said that any need for more channels for control of model aircraft should be met in the Radio Control Service. It also noted that AMA has a petition for rulemaking (RM-3248) currently before the Commission which asks for such additional frequencies."

This basic information was provided again in a July 1983 issue of the magazine, and two times since 1985 in this column. Further, a very well-prepared article on six-meter operation appeared on page 35 of the January 1995 issue of Model Aviation; it contained reference to non-amateur use of six-meter equipment.
I empathize with the writer of the recently received letter. He is an amateur and is learning to fly R/C. The problem revolves around the fact that his instructor is not a licensed amateur. Whenever the instructor flies the model, federal regulations and the AMA Safety Code are being violated. That creates a knotty problem for the modelers involved. Unfortunately, the Academy cannot condone such operation.
Another issue that has been explained several times over the years, but bears repeating, is the probationary period for new Contest Directors (CDs). When a member becomes a CD, he or she is understood to be serving a probationary period until such time as the person has been sanctioned at an event and satisfactorily filled out all the necessary paperwork. Once that point is reached, they are removed from probationary status and any incident that they run will result in the individual receiving an earned membership for the following membership year.
Examples:
- Member becomes CD in March 1995, sanctions and runs an event in June. The probationary period ceases when the event paperwork is sent to Headquarters. Another event is sanctioned in September 1995 and a report filed. In 1996 the CD will receive an earned membership for that year.
- Member becomes CD in August 1995, runs an event in September. Probationary period ends. Next event sanctioned in April 1996. The CD will receive an earned membership for 1997.
Other factors can result in an established CD being placed on probation. Reasons for such action generally include activities that tend to place the Academy in jeopardy — for example, allowing non-AMA members to fly in an AMA-sanctioned event. Although rarely done, the Executive Council has removed an individual's CD status.
Another CD concern that has popped up recently centers around rescheduling or delaying an event to a date other than the one originally assigned. While this can be accomplished, it is not a unilateral action on the part of a CD. If the CD must reschedule due to weather, field availability, etc., this must be done by contacting the district contest coordinator and AMA Headquarters.
On occasion we have had contest reports returned with dates changed from the original ones on the sanction — in some cases months after the scheduled dates. In one case, the event was held ahead of the scheduled date with no contact to the coordinators or Headquarters. In those cases the event is not considered to have been sanctioned. Under those circumstances, since additional-insured certificates for site owners and sponsors are dated, there may not have been coverage for those entities for the event.
